If Boys Are Stupid . . .
Recently, a brouhaha has erupted over a tee-shirt distributed and sold by an outfit called David and Goliath. For starters, it is too bad that David isn't around to sue for use of his name without permission, and Goliath, well, he still hasn't recovered from that rock David threw at him.
The shirts in question read as follows:
"Boys Are Stupid, Throw Rocks At Them"
Our comment is this: If this is protected by the First Amendment, is not "fighting words" or a "true threat", or "obscene", or any of the other forms of speech recognized as outside the Constitutional protection, then the following sentence is equally protected by the Constitution:
"Judges who refuse the enforce the Constitutional Rights of noncustodial parents ordered to pay child support, politicians who likewise violate their oath to support, protect, and defend the Constitution, and support enforcers are stupid,
Throw Molotovs at Them"
Of course, we do not advocate or support any violence such as throwing rocks or bottles of burning gasoline.
We merely submit the second sentence as an example of what is Constitutionally protected if David and Goliath's tee-shirts are Constitutionally protected.
