State Writ of Prohibition Against Contempt Prosecution where I was forced to file a Motion to Modify Commissioner's Decision citing Antipeonage Act because the State of Washington imposed a court order that is a direct violation of the Antipeonage Act, requiring me to maintain at least 30 hours of work per week or make 3 job contacts. Therefore, I display my Brief of Appellant because this is an issue of extreme public importance for which the public should be aware.

One analogy to illustrate the absurdity of the proposition that choice of employer avoids finding of involuntary servitude is with Washington's Death Penalty statute, RCW 10.95.180(1) grants the condemned a choice: lethal injection or hanging. No one seriously argues that merely because the condemned has a choice in his demise, there is no death penalty. However, California's Moss v. Superior Court, the Ninth Circuit's Ballek, and Hawaii's Doe uses this precise logic: if the peon has a choice of employer, there is no involuntary servitude!

Allow me to let you in on a dirty little secret here. Consider this: Say you are a judge in Washington's court system. Or any other court system actually, but Washington is the one I am most familiar with. We all know about the incredible and universal gender bias in family law, and the absolute lack of respect for noncustodial parents as human beings. Observing this is like observing that the sky is blue. But it is just not credible that ALL of our judges are THAT BIGOTED. SOMETHING is placing the thumb on the scales of justice here, that is the only explanation that makes sense! And here is what it is: As a judge, you know that if you make a ruling that offends certain elements in our society you will be BORKED! In Washington, there are two primary means of borking a judge. 1) Putting up credible sounding candidates against your re-election when judges who NEED to be removed for their refusal to enforce Constitutional rights of politically incorrect litigants (meaning noncustodials and others) never face a challenger. Judge Jeanette Burrage suffered from that fate, and from her own foolishness in admonishing female attorneys for wearing pantsuits instead of dresses. 2) A campaign of judicial conduct complaints. Justice Richard Sanders has experienced this. Power Structure just does not like his dissents, but what saves him is that he is popular with the voting public, the only thing that comes even close to frightening the Power Structure. Notice I use capital letters. Everyone in Washington smarter and more observant than a doorknob knows we have one, even if we cannot "prove" it. An organization with access to, say, numerous divorce files without having to spend hours at the courthouse looking them up, would be in a perfect position to organize a CAMPAIGN of Judicial Conduct Commission complaints against a judge who pissed them off. Litigants in these divorces unhappy with this particular judge will be happy to fill out and file these complaints when prompted. And because judicial conduct complaints are mostly SECRET, we do not know and cannot verify, if there is ACTUALLY A CAMPAIGN of such complaints against a particular judge. Because every judge is a human being, and therefore not perfect, there will be at least one incident described in these complaints, where the judge messed up bad enough to warrant discipline!
Same thing with lawyers, which might explain their fear of FORCEFULLY representing noncustodial parents and even to mention the Antipeonage Act in the same context as family law.
So what do we do? Answer is to realize that the thumb on the scales of justice is political, and is motivated by some unreasoning hatred of noncustodial parents, and/or the Seven Deadly Sins including avarice (fancy word for greed) and there is only one thing we NEED to do in ADDITION to everything else we do: Put OUR thumb on the other side of the scales of justice.
Judicial Conduct Commission complaints, folks. Bar complaints against support enforcer attorneys. EVERY time they give you cause to file such complaints! Clue: What works are lies, excuse me, "misstatements of fact" ;-), told by attorney to court that were uncorrected and repeated after you asserted that the truth is otherwise. Back it up with evidence. That gets the disciplinary counsel fired up!

Anthony Akridge, Tacoma, Washington Was working at the Echo Glen Children's Center as a Juvenile Rehabilitation Counselor Assistant in 2001 Because this involved contact with vulnerable children, he was subject to a background check requirement newly imposed for current employees. No such requirement was apparently necessary when he first hired in. He had disclosed his criminal conviction before hiring in, but the rules changed after he hired in. It appears this support enforcement tech position was to settle his claim for an alternative position where he is not required to be in contact with vulnerable children. Just vulnerable information. Sensitive. In a law enforcement function, even if it is a crime of peonage. He said that he would take a position in King, Pierce, or Thurston Counties. Turns out, he did have previous issues, for which the Personnel Appeals Board affirmed discipline. Inappropriate touching of female children is not good, but a shoulder hug to comfort a girl who is crying and upset is not inappropriate. The Information and Certificate of Probable Cause filed in King County No. 82-1-02218-3 alleged that Anthony Akridge snatched a purse from a woman. When the woman attempted to retrieve the purse, he pounded her head with his fists to deter such recovery attempt. Such use of physical force and the implied threat of continued use of physical force to deter further attempt to recover the stolen purse was found sufficient by the jury to prove all elements of the crime of Robbery 2. He made his getaway in the car driven by co-defendant Demetria J. Jones, who was originally charged with false reporting and interference in an officer's official duties. Charges against him were dropped on motion by the prosecutors when he turned state's evidence. Akridge's previous convictions in King County were submitted by the prosecution as evidence that he was a habitual criminal. Anthony Akridge went by several aliases, including "Robert Jones" "Sidney Cain" and "Earl Anthony Jackson" Sidney Cain has about 2 dozen criminal cause numbers listing him as a defendant in King County, one, No. 06-1-00252-7 was just recently filed and dismissed without prejudice. In February 2006, in No. 05-1-13650-9 he pled guilty to a violation of the Uniform Controlled Substances Act. "Earl Anthony Jackson" is probably a made up name with no intended reference to any real person, inspired perhaps by the then incredibly successful professional bowler Earl Anthony. "Robert Jones" is a common generic name, a large number of them are registered to vote in the State of Washington. For obvious reasons, Anthony Akridge is not.

She lists these Pierce County District Court judgments and complaints on her Schedule F as general unsecured debts. Her Chapter 13 Plan, which was confirmed as proposed by one who earns her living by enforcing other peoples' financial obligations, who, under 11 U.S.C. §523(a)(5), cannot obtain this kind of relief, provides that the unsecured general creditors are not to receive any dividend at the end of the 36 months of the Plan, unless otherwise directed. That means they are to be STIFFED!!! The unsecured creditors will receive ZERO payment!!!! And can never again attempt to collect any part of these debts. The Plan was modified to account for a United States Department of Education claim for $18,576.25 in student loan debt. JLBA acknowledged that this debt will survive the Plan and she desires that any dividend available from her payments to the Trustee be paid to this student loan debt. What is interesting is that she originally listed $25,300 in student loans from private banks on her Schedule F. Do these survive the Plan? No payments are scheduled to be made on these two student loans during the Plan. The total Schedule F debt toward which no payment is to be made, including the two student loans from private sources, the Pierce County District Court judgments and complaints, and a bad check made out to COSTCO for $507.00, Pierce County District Court No. 97772184C, is $75,368!!! If any of this money was used to obtain goods for the benefit of her children, then she will be getting out of paying some of her own child support. One other little detail: JLBA listed herself as divorced and listed as an asset her claim for $30,000 in unpaid child support she claims is uncollectible.
Comment: We do not know the details or reasons for JLBA's divorce. We can only speculate why a marriage might end when it includes a woman who leaves unpaid bills to be sent to collection agencies, writes a bad check, and piles up such an enormous debt while earning a steady State paycheck, and why the former husband does not pay the child support as ordered. This website chooses not to.
Dawn Rae Bostrom, Tacoma, Washington 98443 DOB October 17, 1971 Been a secretary since about 1990 and then finally promoted to Support Enforcement Tech. Filed a Chapter 13 bankruptcy, In re Bostrom, United States Bankruptcy Court, W.D. Wash. No. 03-48300. Her initial Plan provided ZERO funds for her unsecured creditors to whom she owed $29,115.00. However, she apparently relented and decided to pay $9,606.25 to those unsecured creditors who filed claims, according to the Chapter 13 Trustee's Final Report and Account. The rest of her unsecured creditors are STIFFED out of about $19,508.75! These unsecured creditors received ZERO payment!!!! Now, unless you meet certain extreme hardship criteria, which Mr. Espana apparently did not claim, you cannot discharge student loans through any form of bankruptcy. What you can do is have the Chapter 13 trustee make your monthly student loan payments with the money you agreed to let him garnish from your paycheck. But gosh! You can make those payments yourself! So why did Mr. Espana do a Chapter 13 bankruptcy? It was to discharge the $97,930.34 in unsecured Schedule F debts he had in addition to his student loan debt! During the 36 months of his Chapter 13 Plan, Mr. Espana, through the Trustee, paid $11,754.46 toward these unsecured debts, leaving the unsecured creditors STIFFED out of $86,175.88!!!! He still owes a pile of money on his student loans, he just picks up where the Trustee left off when the Plan came to an end, but the unsecured creditors are SOL!! Here are some examples of these unsecured debts: Macys Visa: $3,234.38 of which $129.38 is paid. Fingerhut: $301.58 of which $12.06 is paid. GECC: $3,609.91 of which $144.40 is paid. Max Flow Corporation: $8,402.23 of which $336.09 is paid. Sears Roebuck and Company: $8,689.73 of which $347.59 is paid. Bon Marche: $1,218.24 of which $48.73 is paid. What other benefit did Mr. Espana realize from his bankruptcy? He was able to sell his condo in Everett and buy, with a mortgage secured by a deed of trust, a house in Marysville! Presently working in the Fife Office. If you got laid off because your employer Sears, Max Flow, or Bon-Macys is having to cut costs because of insufficient sales revenue and too many losses such as this, well, that's not Mr. Espana's problem! Even if such causes you to fall behind in your child support. He will be happy to refer you to the county prosecutor for contempt proceedings and to initiate license suspension!

When you do that, then you have some background information to consider. A criminal record is not necessarily bad, such persons can learn their lesson and reform.
Even druggies and alkies can get clean and stay clean. However, a relapse into drug or alcohol addiction can be a wonder to behold! It is truly one of the most amazing things I have ever seen in my life!
Somewhat surprisingly, not to me but to too many other men, it is a lady's CIVIL litigation history that raises the red flags. Is she a defendant in a string of collection and commercial cases, unlawful detainers? She ever petition for Chapter 7 bankruptcy when she has a job? Then don't go with her if you think financial responsibility, spending within your means and BEING CAREFUL with your hard earned money are important to you.
The real important thing for you to watch out for are the domestic violence or civil harassment petitions.

No such petitions are no guarantee, there is always a first time.
One petition, she might have met a Mr. Wrong and she might do just fine with a Mr. Right.
But FOUR petitions? And two where she is a respondent? RED FLAG! RED FLAG! RED FLAG! RED FLAG! RED FLAG! RED FLAG!
If it is with the same guy, all that means is that SHE DOESN'T LEARN A DAMN THING! When men get angry with their women, that is at the top of their list as to why!
If it is with different guys, hmmm.
If you are going out with someone with a record like Ms. Harris, and you wish to have a happy life with a minimum of problems, and ZERO court problems, RUN!!!!

Something else we need to mention when it comes to Chapter 7 discharges on trustee's reports of no distribution. If Sweet Polly Purebred loaned a ton of ALPO to Underwood during the years prior to this Chapter 7 bankruptcy and Underwood neglected to list it on her Schedule F, and consequently Miss Purebred never found out about the bankruptcy until after it was over when she filed a lawsuit to collect, guess what? Miss Purebred's lawsuit is automatically dismissed upon the defense of bankruptcy discharge. WHAT!!!!! Yes, Sweet Polly is dog poop out of luck! The way the courts look at it is to ask the question: Was Miss Purebred prejudiced by the lack of notice? Unless Miss Purebred can answer that question with evidence that she could have submitted at the creditor's meeting of Underwood's possession of HUGE AND NON-EXEMPT ASSETS NOT REPORTED IN THE BANKRUPTCY PETITION that would have resulted in a trustee's report of SOME distribution, her motion to reopen will be denied.
