State Writ of Prohibition Against Contempt Prosecution where I was forced to file a Motion to Modify Commissioner's Decision citing Antipeonage Act because the State of Washington imposed a court order that is a direct violation of the Antipeonage Act, requiring me to maintain at least 30 hours of work per week or make 3 job contacts. Therefore, I display my Brief of Appellant because this is an issue of extreme public importance for which the public should be aware.

Petition for Writ of Certiorari to the United States Supreme Court is considered filed as of the date I mailed it, August 8, 2007, within 90 days of June 6, 2007. It is docketed as No. 07-184.
One analogy to illustrate the absurdity of the proposition that choice of employer avoids finding of involuntary servitude is with Washington's Death Penalty statute, RCW 10.95.180(1) grants the condemned a choice: lethal injection or hanging. No one seriously argues that merely because the condemned has a choice in his demise, there is no death penalty. However, California's Moss v. Superior Court, the Ninth Circuit's Ballek, and Hawaii's Doe uses this precise logic: if the peon has a choice of employer, there is no involuntary servitude!

Allow me to let you in on a dirty little secret here. Consider this: Say you are a judge in Washington's court system. Or any other court system actually, but Washington is the one I am most familiar with. We all know about the incredible and universal gender bias in family law, and the absolute lack of respect for noncustodial parents as human beings. Observing this is like observing that the sky is blue. But it is just not credible that ALL of our judges are THAT BIGOTED. SOMETHING is placing the thumb on the scales of justice here, that is the only explanation that makes sense! And here is what it is: As a judge, you know that if you make a ruling that offends certain elements in our society you will be BORKED! In Washington, there are two primary means of borking a judge. 1) Putting up credible sounding candidates against your re-election when judges who NEED to be removed for their refusal to enforce Constitutional rights of politically incorrect litigants (meaning noncustodials and others) never face a challenger. Judge Jeanette Burrage suffered from that fate, and from her own foolishness in admonishing female attorneys for wearing pantsuits instead of dresses. 2) A campaign of judicial conduct complaints. Justice Richard Sanders has experienced this. Power Structure just does not like his dissents, but what saves him is that he is popular with the voting public, the only thing that comes even close to frightening the Power Structure. Notice I use capital letters. Everyone in Washington smarter and more observant than a doorknob knows we have one, even if we cannot "prove" it. An organization with access to, say, numerous divorce files without having to spend hours at the courthouse looking them up, would be in a perfect position to organize a CAMPAIGN of Judicial Conduct Commission complaints against a judge who pissed them off. Litigants in these divorces unhappy with this particular judge will be happy to fill out and file these complaints when prompted. And because judicial conduct complaints are mostly SECRET, we do not know and cannot verify, if there is ACTUALLY A CAMPAIGN of such complaints against a particular judge. Because every judge is a human being, and therefore not perfect, there will be at least one incident described in these complaints, where the judge messed up bad enough to warrant discipline!
Same thing with lawyers, which might explain their fear of FORCEFULLY representing noncustodial parents and even to mention the Antipeonage Act in the same context as family law.
So what do we do? Answer is to realize that the thumb on the scales of justice is political, and is motivated by some unreasoning hatred of noncustodial parents, and/or the Seven Deadly Sins including avarice (fancy word for greed) and there is only one thing we NEED to do in ADDITION to everything else we do: Put OUR thumb on the other side of the scales of justice.
Judicial Conduct Commission complaints, folks. Bar complaints against support enforcer attorneys. EVERY time they give you cause to file such complaints! Clue: What works are lies, excuse me, "misstatements of fact" ;-), told by attorney to court that were uncorrected and repeated after you asserted that the truth is otherwise. Back it up with evidence. That gets the disciplinary counsel fired up!

A bit of advice for all you Romeo's out there. When you find yourself with a lady and it starts to look serious, you might want to scan her name through the Superior Court search engine. And the Name Search.
If she has a common name you will want to eliminate the Katherine Smiths who are not her.
When you do that, then you have some background information to consider. A criminal record is not necessarily bad, such persons can learn their lesson and reform.
Even druggies and alkies can get clean and stay clean. However, a relapse into drug or alcohol addiction can be a wonder to behold! It is truly one of the most amazing things I have ever seen in my life!
Somewhat surprisingly, not to me but to too many other men, it is a lady's CIVIL litigation history that raises the red flags. Is she a defendant in a string of collection and commercial cases, unlawful detainers? She ever petition for Chapter 7 bankruptcy when she has a job? Then don't go with her if you think financial responsibility, spending within your means and BEING CAREFUL with your hard earned money are important to you.
The real important thing for you to watch out for are the domestic violence petitions.
Okay.
No such petitions are no guarantee, there is always a first time.
One petition, she might have met a Mr. Wrong and she might do just fine with a Mr. Right.
But FOUR petitions? RED FLAG! RED FLAG! RED FLAG! RED FLAG!
If it is with the same guy, all that means is that SHE DOESN'T LEARN A DAMN THING! When men get angry with their women, that is at the top of their list as to why!
If it is with different guys, hmmm.
If you are going out with someone with a record like Ms. Bailey, and you wish to have a happy life with a minimum of problems, and ZERO court problems, RUN!!!!
Oh yeah, you can say, quite self righteously and with an air of moral superiority:
"I have never hit a woman in my life and I will NEVER EVER HIT A WOMAN!!!"

Maybe you have never been TESTED. Do you really want to be TESTED?

The "stupid bitch", after receiving such instructions, will answer the door and accept the papers!
You are a starting tackle on the best offensive line in football, you win your first playoff game, and you go out to celebrate. What does she do? She embarrasses you and humiliates you in public! You "discuss" this with her in the back alley and the cops haul you off to jail!
We don't need this shit!
And if none of the guys she petitioned against ever hit her, or only raised their voices because they can't help themselves, then she is a MALICIOUS PERJURER! Or a backstabber! Who needs that?

Then she moved to convert from Chapter 13 to Chapter 7 on the grounds that she could not afford the Plan payment she herself voluntarily proposed. NOBODY ASKS US IF WE CAN AFFORD THE CHILD SUPPORT SHE USED TO ENFORCE!!!! But guess what? The motion to convert was granted. The Chapter 13 wage deduction is terminated and no funds are distributed by the Chapter 13 trustee to any of the unsecured creditors listed on Schedule F. The Chapter 7 trustee filed a Report of NO Distribution which means that the unsecured creditors got STIFFED: Alaska USA Federal Credit Union $6,295.99; Bank of America $12,842.89; Boeing Employees' Credit Union $15,219.25; JCPenny $2,807.20; Nordstrom $601.36; Sallie Mae $9,752.48; Sears $932.90; and Sears Gold Master Card $5,119.79. Recently Brita Hofto has been in trouble with her job. First she had her salary reduced, affirmed by the Personnel Appeals Board, and then dismissed. Not on the 2005 DSHS Employee List. King County No. 08-2-03769-0 plaintiff employment discrimination suit, specifically wrongful termination under Family Medical Leave Act. Filings include declarations of Brita Hofto, Kathryn Battuello, Teresa Dillon, and Sharon Redmond. Then the case is dismissed on summary judgment. No appeal. Primary argument for dismissal on summary judgment presented by the State through Assistant Attorney General Kathryn Battuello is that the 3 year statute of limitations had run out on the claim. In her Declaration, Brita Hofto testified that she was a support enforcement officer with the Seattle DCS from 1992 through 2004. Her problems began when Sharon Redmond took over as District Manager and started interfering with her FMLA rights. She was struck from consideration for Disability Adjudicator, outside of DCS, while her appeal was pending before PAB. She claimed retaliation for filing a union grievance. Union grievance procedure was ineffective. Donna Hengeveld informed her that leave was unauthorized because of "inconsistencies" in the medical authorizations. Brock Genereux informed her that she would be disciplined for any absences unrelated to FMLA. Declarations filed by the state presented and authenticated as exhibits poor performance reviews, absences, and numerous disciplinary notices concerning will refusals to provide adequate medical documentation for her absences and poor performances, errors in calculating child support amounts and payments, failures to maintain workload, and to follow up complaints and concerns brought by custodial and non-custodial parents.
It is very difficult to win an employment discrimination or wrongful termination case. Due to the fact that we are human, there will be errors in our performance on any job, and employers are usually very good at keeping records and documenting every misstep by every employee in case they decide to terminate such employee and such employee files suit. While Congress and the Washington Legislature has passed some good legislation offering some protection for employees to prevent certain kinds of discrimination, the fact is that if an employer can produce evidence of lawful reasons for the termination, then the courts are sympathetic to the employer. This case is an example of this.

Responded to DV call at residence. Incident happened between 5 and 6 pm September 15, 2007. Mrs. Jackson gave testimony to Officer O'Brien. She got on Lamont's case about Internet usage. He pushed her to the ground, kicked her in the back of the head and screamed: "You're going to make me kill you!"
Mrs. Jackson then related an earlier incident to Officer O'Brien. August 18, 2007 at about 1:30 to 2:00 AM. The family was in the bedroom and Lamont was surfing the Net. She got on his case about it. Lamont responded by hitting her in the right cheek with left fist causing pain and profuse bleeding. He knocked over the television set and the crib with the baby in it. Mrs. Jackson picked up the child and ran to cordless phone. Called 911. Connected with dispatcher and screamed for help. Lamont grabbed phone from her hands, disconnected call and removed the batteries. Knocked Mrs. Jackson to the floor between bed and west wall while she was holding child. He held her down, covered nose and mouth with hands making it impossible to inhale. She struggled and he then placed his hands around her neck and choked her until she lost consciousness. She regained consciousness when the dispatched officers knocked on the door. She continued to attempt to scream but Lamont held her down and clamped his hands over her mouth to keep her from alerting the police.

When I looked at the ECR file of this case, I did not notice any statement where Mrs. Jackson was taken to a hospital or medical clinic for treatment. If such evidence is not presented by the prosecutors, a jury can rationally acquit on the Assault 2 charge in compliance with the lack of evidence part of the reasonable doubt instruction.
If you look at this in terms of the Power and Control Wheel, you could say that, gee, he is trying to power and control her. But wait! His use of the Internet is not an attempt to power and control anybody or anything! By her own testimony to Officer O'Brien, in both incidents she attempts to regulate his use of the Internet. His violent reactions are not an attempt to power and control her, rather, to prevent her from power and controlling him!
Aside from looking at these incidents through an ideological prism, does this make ANY sense? She is CHOKED UNTIL UNCONSCIOUS, AND THEN NOT ONLY DOES SHE NOT SEEK MEDICAL ASSISTANCE OR CONTACT THE POLICE AT FIRST OPPORTUNITY, she remains living with him until almost a month later. Then she brings up his Internet usage, the thing that set him off before!
Think about this. August 18, 2007 is a Saturday. On Monday, August 20, Lamont would be at 500 1st Avenue South committing peonage crimes. That would be her opportunity to do the equivalent of calling in a B-52 strike against him! What she describes is serious business for which she should have gone to the police and then to a hospital or clinic! Yet she recklessly endangered her child and stayed with a homicidal maniac.
Either Mrs. Jackson is a stupid bitch.
Or she is lying through her teeth or falsely exaggerating the incidents.
On October 29, 2007, the State filed a motion and order amending information to add Bellevue Police Department Incident Number 07-11847 written by Officer M. McBride. It is alleging that Lamont violated the no-contact order by calling his wife everyday since October 16, 2007. 206-389-3120 is a work number at Seattle DCS. Lamont sometimes calls from this number.
Lamont asked his wife to tell her physician that she had post-partum depression. She did, and got a prescription for prozac. Lamont asked her to tell his public defender Tim Johnson that she had post partum depression and that she made the domestic violence thing up. She responded that she could not do that for she could wind up in jail for perjury. By making Tim Johnson a witness, he had to withdraw from representation to comply with RPC 3.7.
Well, yes, false reporting of a crime is a crime. It can constitute malicious prosecution, RCW 9.62.010 resulting from false statements intended to mislead public servants in the performance of their duties, such as inducing them to falsely arrest, imprison an innocent citizen of a crime, which is Perjury 2, RCW 9A.72.030. For her to recant would be to confess to false reporting. However, there is the saving clause of RCW 9A.72.060, which allows those who retract false statements early enough in a civil or criminal case to avoid prosecution for the perjury.
Even if Mrs. Jackson is lying and the domestic violence never happened, I can see why she would feel trapped in the course of action commenced, whatever second thoughts she may have.
After Mrs. Jackson told Lamont that she cannot retract her statement, Lamont yelled about this being a woman's state.

The Amended Information repeats the above listed counts, and adds Tampering With a Witness - DV RCW 9A.72.120 and DV Misdemeanor Violation of a Court Order, RCW 26.50.110(1)
That is what is so magical about no contact orders. They split the family and PREVENT any effort at communication and reconciliation, any effort by the blindsided man to WORK THINGS OUT with his woman is the crime of tampering with a witness in addition to violating the no-contact order.

For the sake of argument, what if Mrs. Jackson decided to sabotage her marriage and get rid of her inconvenient man, while still being able to collect child support or welfare, by staging this drama episode and either provoking anger and/or falsely accusing him of violence?
What are Lamont Jackson's options? Might there be something WRONG with the design of this system?
Please give it some thought. And allow the results of your thinking affect the way you vote.
Finally, on Tuesday, January 8, 2008, the trial got going. At first it was assigned to Judge Nicole MacInnes. The defense affidavited her and she recused. Then had to wait for another judge to become available. The case was assigned to Judge Chris Washington. In the afternoon the attorneys and Mr. Jackson were finally ready to begin proceedings. Jackson is presently in custody and the jail guards brought him over wearing regular clothes, including shiny black leather shoes. This is the protocol for trials, as courts have found that juries can be prejudiced against a defendant wearing jail clothes.
Prosecution moved to amend the complaint, which was opposed by the defense. Defense moved to sever the counts. Judge Washington took these motions under advisement, will rule on them later.
The counsel started with a CrR 3.5 hearing on the admissibility of statements Jackson allegedly made in the presence of arresting police officers after being given the Miranda warnings. Officer Matthew O'Brien testified about the arrest of Lamont Jackson in Lacey and the transfer of Mr. Jackson from the Lacey Police Department to his custody in Fife. He read the Miranda warnings. Lamont waived the Miranda rights and stated that the arguments were about an affair Venus Jackson, his wife had.
In the courtroom, Lamont shook his head while the former Officer O'Brien testified.
Officer O'Brien booked Lamont in at the Bellevue Police Station.
Here is an interesting aside: 5 days after Officer O'Brief took the report from Venus Jackson, our Mrs. Jackson, and handled the arrest of Lamont Jackson, he was laid off from the Bellevue Police Department near the end of his one year probationary period. They decided he was not a "good fit" for Bellevue.
One of the reasons might be that as he failed to adequately document the Miranda warnings that he read off to Lamont, Judge Washington ruled that Lamont's statements to Officer O'Brien while being transported are inadmissible.
This is one of the reasons I was holding off reporting this.
The jury selection dragged on and we did not get to the meat of the voir dire until Monday, January 14, 2008. I missed this as I had pressing business to attend to. On Tuesday and Wednesday, January 15 and 16, 2008, Venus Jackson, the complaining witness and alleged victim, gave her testimony under oath.
Venus Jackson is a comely black woman with a pretty face. She is tall for a woman, about 5' 9" or so, with a stout build. When she walked past me going out the courthouse door on the Fourth Avenue side, I was left with the impression that she is as strong as an ox. I can understand Lamont being sexually attracted to her.
On the witness stand, she affected sniffles and tears, but not too much. She first described meeting and marrying Lamont Jackson. She got him a job with the Division of Child Support through a friend who worked there. (First red flag!) She then described the August 18, 2007 incident. She brought up his viewing Internet porn. Lamont hit her in the face. When police were outside, Lamont was crying and promised not to hit her again. They argued back and forth. She saw history of websites visited. She had hand in the crib. He pushed her, she went back and took the crib with her, the bed caught the crib. When she tried to get up, he punched her in face with closed fist making mouth bleed inside. He took cell phone when she called 911 and removed the batteries. He threw the phone. He was on top of her. Baby next to her. He sat on top of her chest.
Covered mouth and nose. She could not breathe, trying to scream. Two hands around throat. Hitting her. Screaming.
Then waking up with the lights off.
Aware of police outside. Did nothing to alert police. He was crying. Told her to be quiet. Was scared. Don't know why she did not alert police.
The next day, August 19. Lamont said he was sorry, never hit anybody before. Promised not to hit her again. Didn't tell anyone about incident. There were no bruises or swelling on outside of face. No visible marks.
Planned to stay with Lamont after August incident. Never worried about Lamont hurting the baby. Things seemed to be okay. Talked about "source of the problem" meaning his viewing Internet pornography.
Second incident. Friday night, she found out that he continued to view porn. Was really frustrated. More tears. Argued. Told him she was cheating on him. To hurt him. Not true. He reacted by pushing on her. Baby there. She fell. He stood over her. Called her a bitch. Told her she was going to make him kill her. Kicked her from behind hard. Venus drew a map of the apartment. After he talked about killing her, she ran out of the apartment, and said nothing about where she was going. She took her purse but did not take the baby. Didn't think he would hurt the baby.
Drove to Renton. Two glasses of wine at a place, cannot remember where. Drive for a while and then arrived at Factoria Mall, which is near where they lived. Saw a former co-worker, "Shawn". Walked around. Didn't call police while out.
Figured it was normal for a husband to react angry upon her claiming adultery. Finally went back to apartment. Wanted to talk about it. Found, Lamont, baby, and computer gone. Some baby things gone. No note. Message on phone. Lamont said he was leaving with baby. She panicked, found wedding pictures torn up. Called 911. Police came.
In Lacey, Sheila and Eddie Sims are Lamont's aunt and uncle. Called the Sims' they did not answer. Called police because he took baby. He didn't have a car. Gave police the Sims' phone number. After talking with police, she talked to her brother's girlfriend. Girlfriend took Venus to Lacey to pick up the baby. While in Lacey, found out that Lamont had been arrested. The Sims' were angry with her.
Venus tried to get Lamont out of jail. She tried to help post bail. She spoke with defense attorney Timothy Ray Johnson by telephone for 20 minutes or so. She told him that Lamont did not hurt her. She would not have called the police if he had not taken the baby. She then contradicted herself by saying that he caused her pain, but no black eye or other such injuries.
She has been learning about domestic violence since. On the witness stand, she admitted to LYING to Tim Johnson. 3 weeks after arrest, Lamont called her at work. Told her to go to doctor and get diagnosed with post partum depression. On the witness stand she testified that she never had post partum depression. Told doctor she was sad and depressed since she had baby. All LIES. Doctor prescribed Prozac. She did not take it.
Got scared of lying to defense attorney. Lamont called her 3 or 4 times from work and at least once from the jail. She expressed to him her concern about lying. He said to not worry about that, this is a women's state. He suggested that she not show up for court.
On cross examination, Carey L. Huffman gently went over discrepancies in her testimony and further brought out her issues about Lamont viewing Internet porn.
Before watching this testimony, I thought it might be possible that Lamont committed the violent crimes with which he was charged. After this, I am convinced that he did not. Taking her testimony while on witness stand under oath at face value, Venus first LIED to her husband about cheating on him to deliberately provoke his anger. She then LIED to his first defense attorney. She LIED to the physician. Not only did she LIE to the physician, she did so to obtain a prescription for Prozac under FALSE pretenses. However, Prozac is not a controlled substance. But it can have dangerous side effects if used by a person who does not need it.
And there is no testimony or evidence to corroborate her testimony as to the assaults and to the injuries.
If I was on the jury, I would vote to acquit.
But I was not on the jury, and the jury acquitted on the Assault 2 charge, but convicted on the lesser included Assault 4 - DV, convicted on the other Assault 4 - DV arising from the second incident, convicted on the Felony Harassment, Tampering with a Witness - DV, and 2 counts of Violation of Court Order. The Felony Harassment will cost Lamont Jackson his right to keep and bear arms until restored by court order and his right to vote until he completes the sentence and pays the fines, costs, and assessments.
All I can say is, even if he is totally innocent, he deserves this for working for the Division of Child Support, part of the apparatus that renders it feasible for women to just toss the fathers of their children out the door.
And Venus deserves to not get child support for sending her husband off to prison. Apparently she does not believe she needs it.

Why does a woman with a FULL TIME state job NEED an award for separate maintenance of $700.00 per month? The reason for the deviation stated in the support order is, get this: it is allowed because of a shared parenting arrangement, each parent gets the kids 50% of the time, and because it does not leave the receiving parent's household with insufficient funds to meet the basic needs of the children! Now what did I plead in Knight v. Schmitz, 9th Cir. No. 35459? That under Troxel v. Granville, any support order beyond that which is necessary to allow the custodial parent to meet the basic needs of the children is offensive to the 14th Amendment as interfering with a parent's fundamental right to make his own decision as to the custody, care and raising of the children. Including how much money to spend on such children beyond that which is necessary to meet their basic needs. Here, we have a support enforcer himself saying that the "standard calculation" pursuant to Peter Nickerson's economic table is $357 beyond what is necessary for his ex to enable her to meet the basic needs of his children. Then there was a modification to this child support order: BGK's monthly net income increased to $2,858, he is a "Program Administrator", and her monthly net income increased to $2,113. The standard calculation for him to pay her is $1,005 per month. He obtained a reduction to $520 per month! Same reason stated for the deviation in the order on modification. Apparently the couple agreed she needed $80 LESS per month to meet the basic needs of the children. The standard calc results in an order this couple believes is $485 more than would be allowed under a fair reading of Troxel v. Granville! Remember: he earns his money enforcing orders of the sort he did not want imposed upon himself.

If you earn more than the median family income, there are a bunch of new mathematical tests to keep the "presumption" of abuse from arising or to rebut said presumption. While you cannot get rid of a child support debt under the new Bankruptcy Code anymore than you can under the old Code, you can include child support and alimony obligations in your monthly expenses for the purpose of avoiding the presumption of abuse. Thus if you are clobbered by an unreasonable child support order, you should still be able to use the Bankruptcy Code to get rid of, meaning not pay, your non-child support non-alimony unsecured debts.
Still, you have to admit, as the Republican Base is pissed at their Party for spending too much money and for going along with big new spending initiatives and for failing to get rid of such ridiculous federal laws as the 1.6 gallon per flush toilet rule, and as the moonbat left wing is fit to be tied over Nancy Pelosi not delivering on forcing our surrender in Iraq, and as the immigration policy continues to be "will the last person leaving Mexico please turn out the lights" and as our jobs keep being shipped overseas for cheap labor, where Congress has an even lower approval rating than the common cold, and of course we noncustodial parents have absolutely no reason to support the re-election of anybody,

Officer Donna Rorvik Badge Number 293 of the Kirkland Police Department wrote to the effect: Nathaniel found out about his wife's filing for divorce and they argued. He grabbed her arm causing pain and bruises. When she tried call 911 he ripped the phone cord out of the wall. Then he tried to strangle her by bracing his elbow against her neck. When 4 year old child came to try to get them to stop, he pushed him and the kid slammed into a wall. Officer Rorvik did not witness these events, she is merely recording what the wife was telling her.
Yeah. Remember that DV victims are often coached into making the strangulation accusation.
The result is that Mr. Ray entered an Alford plea to reduced charges of Assault 4 DV, RCW 9A.36.041 and Interfering with Domestic Violence Reporting, RCW 9A.36.150. He claimed in his Statement Upon Plea of Guilty that he is innocent of the charge but was afraid that given the police report and the evidence that the wife could give, he would be convicted and wanted to take advantage of the prosecution's offer. Which incidentally avoids the felony charge but he still loses his right to keep and bear arms as it is a domestic violence misdemeanor. My take on this is that he is either guilty or a coward. It is easier to respect the defendant who owns up to what he did or, if he is actually innocent, stands trial and tries to convince the jury that there is a reasonable doubt.
King County No. 00-2-17027-1 respondent protection order. Result: one year protection order that was not renewed. Here is what I like about the protection order: Respondent is restrained from going within 500 feet of the petitioner's residence. However, her address is CONFIDENTIAL!!!! So how can he comply if he is not allowed to know where she is living? No exceptions are included for limited access freeways or major roads. Then on the next page it states she has the exclusive right to residence in the family home and lists its address! Petitioner thus kept the house that was later lost in the trustee's sale.
King County No. 00-3-05971-3 respondent dissolution with children. The consequences of a divorce upon the husband are usually so catastrophic and contrary to our constitutional principles, and so many men are in denial in that they believe that their loving wives would NEVER do this to them, that it is only natural that when it happens, by surprise, of course they are going to be angry! But then again, maybe he was the kind of bastard who deserved it. It just that it does not matter in a NO-FAULT divorce. We dispense with the due process of law and go straight to the deprivation of property. This is one reason women who make FALSE accusations of domestic violence get away with it. Not that I am saying Mrs. Ray made any false accusations, it is just that the outcome wouldn't have been any different if she did.
Off-topic question: Why is Elin Nordegren Woods getting a pass? Yes, I understand that Tiger committing adultery with multiple girlfriends is reprehensible and Elin should be angry about that, but she allegedly went after him with a golf club! I would call that assault with a deadly weapon. I thought that there was no excuse for domestic violence. Why is she not being charged? If she can take millions from him in the divorce, why can't he take some of those millions back for the tort of personal injury? Now back to our regularly scheduled programming.
King County No. 02-2-05788-8 defendant unlawful detainer. They could not make their mortgage payments and lost the house to a trustee's sale. He was no longer living there but the wife apparently required the new owner to bring this action to move her out. They just named Nathaniel as a party too. Sometimes the man doesn't feel like making the mortgage payments on a house he is prohibited from living in or even approaching within 500 feet.

Ray are both born on September 13, 1969 and lived at the same address in Kirkland. They are both on record for the same four traffic and parking infraction tickets. They are the same guy.
Before the divorce and domestic violence, they filed Chapter 7 bankruptcy, In re Ray, United States Bankruptcy Court, W.D. Wash. No. 97-06072. Trustee's Report of NO Distribution. Unsecured creditors STIFFED. They received ZERO payment!!!! And can never again attempt to collect any part of these debts. Except those party to the 2 reaffirmation agreements which the Rays granted out of the goodness of their hearts. We can all presume that they were not motivated by any threat of physical violence or other threats of illegal coercion, say, imprisonment for debt through contempt proceedings and arrest, because that would be extortion and we would not want anything like that going on!
I am a little skeptical that the Division of Child Support would hire a man with this record (not so surprised if they failed to perform an adequate background check, he-he!) or that he would want to work for them. But then again treason and working against the Constitution is outside my understanding. If the Nathan Ray recently hired by DCS is not this Nathaniel Stephen Ray, please let me know. One interesting thing about the Complaint is that while it lists the charge as both felony and misdemeanor, it is an Information based on an Affidavit of Probable Cause by Mike Nichols, not a Grand Jury Indictment which is required under the Fifth Amendment for capital and otherwise infamous crime and by Federal Rule of Criminal Procedure 7(a) for a felony.
I cannot resist commenting on this. The federal authorities seem to be careful to prosecute only rich guys under 18 U.S.C. §228. Whenever poor guys are prosecuted, aside from 13th Amendment and Antipeonage Act considerations, there are proof problems with capability of making the child support payments and therefore the element of willfulness of nonpayment when the defendant is some blue collar schmo who was clobbered in a patently unfair divorce. If they have to go to a petit jury for trial as in the case of any felony charge, even if Ballek lets them off the hook for jury trial in misdemeanor child support cases in federal court, a jury might prove unduly sympathetic to such a guy.
A Grand Jury might hit upon the idea of indicting those who imposed the child support order for the crime defined by 18 U.S.C. §1581 and upon the federal prosecutors for arresting him with the intent of placing or returning him to such condition! Please see my open letter to Judge Gonzalez for a clue as to how that might happen! This might explain why they prefer to do these kinds of misdemeanors by information!
But with a rich guy like Robert Nowinski, he can hardly claim peonage. How so? His divorce was King County No. 96-3-01494-3. There was a huge amount of property split between the parties. Still, he was quite well off even after this fleecing. His ability to complain is limited by the contractual nature of his prenuptial agreement, which made her marrying him worth her while. Guys, when you make a promise, you make a promise. Gals, when you make a promise, you make a promise, unless the courts decide it is an unfair promise. He had enough money, that if he put it in safe investments such as Puget Sound Energy stock with its large dividend payments, he could obtain a monthly income sufficient to pay the $5,300.00 child support per month, the taxes on that income, with enough left over to allow him to spend every day watching ESPN or surfing the Internet. He could have paid cash for a three bedroom house out in Federal Way or away from King County where they are cheaper, and nobody could do squat to him for being lazy.
Frankly, I would not blame any rich guy for doing that, given the way government treats them when they try to be movers and shakers creating jobs. If every rich guy said "Fuck it, I'll just spend the rest of my days in a little house watching TV," not only would there be considerably less federal income taxes collected as they make considerably less income, but enough to meet their basic needs, the effect would be economically DEPRESSING! Imagine the Walton Family shutting down every Wal*Mart and laying everyone off. William Boeing sold his airplane company to people interested in running it for profit. If it weren't for investors willing to put up with the risks and the headaches, there would be no Boeing Company. William Boeing would not have had to care as long as he came out of it with enough cash to meet his needs. Atlas can shrug!
Anyway, Nowinski continued to move and shake. He moved to New York, his first mistake in terms of 18 U.S.C. §228 liability. I am safe from this kind of federal prosecution because I have a Ninth Circuit unpublished memorandum vacating a challenge I made to 18 U.S.C. §228 on the basis that I lack standing due to me and the kids being in the same state. Apparently some of Nowinski's deals turned out to be a little too screwball and he had to file for bankruptcy in New York. In the process he stopped making the child support payments.
And there we are. Now we can condemn Mr. Nowinski, and we can see how he made some dumb decisions. But hey, his ex-wife came out of the divorce with MILLIONS! She does not NEED to collect the child support to adequately provide for her children! I would suggest that Mr. Nowinski make a Troxel v. Granville based challenge to the whole thing on the grounds that where a child support order is UNNECESSARY due to the wealth of the custodial parent, then such an order interferes with the noncustodial parent's fundamental right to make decisions concerning the care of the children, by dictating to him how much money to spend, and therefore violates the Fourteenth Amendment. Please see my pleadings listed on the Knight v. Schmitz, 9th Cir. 01-35459, W.D. Wash. No. C00-1874R where I make this argument.
Mr. Nowinski, I know the judges will not like it. But you're on the hook for a federal misdemeanor, Bub! You might as well plead out every possible defense! Don't worry about pissing off the judges, they are already pissed off! You are the noncustodial, they already don't like you!
That is the problem with bigotry and prejudice in the black robe community.
At least Nowinski would have the advantage of some publicity, however negative. I understand he copped a plea.

AFTER October 17, 2005 he filed Chapter 7 bankruptcy, In re Tran, United States Bankruptcy Court, W.D. Wash. No. 09-19592. While Schedule I listed himself as retired his Statement of Financial affairs listed income received from working for DSHS. So how did this work in practice? The Certificate of Credit Counseling states that no debt repayment plan was prepared. NO!!! The Means Test found that the combined annual income of $91,967.28 is well above the allowable income for a two person household, which is $63,9671 per year. So we go to the Second Part of the Means Test There are a series of allowed deductions from one's monthly income to avoid "the presumption from arising" under the NEW 11 U.S.C. §707(b)(7) exclusion!! In the Tran's case, starting with the monthly income of $7,663.94 these include: IRS National Standard Food Clothing Other: -$985 IRS National Standard Health Care: -$120 IRS National Standard Non-Mortgage Housing Expenses -$502 Car Expenses: -$384 Local Standard Vehicle Expenses: -$489 for each car, $978 for the two cars Taxes: -$1,420 Mandatory Individual Deductions from employment paycheck: -$285.82 Life Insurance: $95.00 Personal Health Care Expenses not covered by insurance (example, co-pay) -$240.00 Home Insurance premium: -$28 Mortgage Payment -$3,542 These deductions add up to $8,580.13 per month, leaving them with a NEGATIVE monthly income for the purpose of avoiding the "presumption of abuse", which is avoided as long as the adjusted monthly income is less than $7,663.94! Or actual monthly income of $7,663.94 + $8,580.13 = $16,244.07!!! Meaning, as long as the Tran's ain't earning that much dough each month, they get to STIFF their unsecured creditors out of however much money they owe them! Just like when you filed before October 17, 2005! Schedule F lists $109,534.81 in unsecured debts and Schedule D claims $22,430.70 as the unsecured portion of the home loan on account the house is worth that much less than the balance of their mortgage. Here is the scooperoo on this lady: In No. 96-1-05422-1 she was initially charged with Assault 2, a felony, assault with a deadly weapon, specifically a knife, and she copped a plea to the reduced charge of Assault 4, domestic violence, a misdemeanor. 12 month suspended sentence. 3 days of imprisonment already served. She keeps her right to vote, but as this case is post Brady Bill and after Washington's incredibly multi-subject Violence Reduction Act of 1994, her right to keep and bear arms is gone. The Certificate of Probable Cause filed with the Information alleges: She was living with the father of her child and the child, a nice evening at home. Started screaming at the father, accusing him of neglecting their child. The father suggested that she was setting a poor example for the child by yelling at him. This prompted the more appropriate behavior of physically assaulting the father while he sat on the couch, hitting and scratching him. The father, faced with a choice between risking the county jail or the county morgue, chose to risk the morgue. Rather than counter-attack in self defense, he retreated through the kitchen and dining room, whereupon dear sweet Jennifer Jean made use of the kitchen utensils. She threw several knives at the father screaming: "I'm gonna kill ya!" One knife punctured the father's left forearm. Jenny Jean picked up a kitchen pot and swung it at her man, then threw it at him hitting his left elbow, bruising it. The father continued his retreat and Jenny followed him ripping his shirt. This father tried to calm Jenny Jean by handing her their now screaming child. As this did not work, he handed the child off to his brother, the kid's uncle. Upon contact with the police, Jenny Jean admitted throwing the knives but denied stabbing her man with them. She admitted the scratching and the throwing of the pot at him. Deputy Prosecutor summed up by declaring that Jenny Jean poses a threat to the community as evidenced by her lack of control in the presence of her child and her use of multiple weapons.
While still under probation for her Assault 4 conviction, Jenny Jean had the AUDACITY to petition for a restraining order against this same man she was CONVICTED of ASSAULTING!! In her petition in No. 97-2-09519-1 she alleged that he was arrested for domestic violence by the Kent Police Department. We can see how this happens: she throws a temper tantrum and he gets arrested for it! The other really TERRIBLE thing he did was that he kept visiting his child at the daycare center!!! Imagine that!! A father looking after his child at the daycare center!!! Next thing you know he will be taking the kid fishing and to ball games and be wanting to talk to his school teachers. He might get in their faces if they try to make the kid take Ritalin! We can't have that! The temporary order imposed a 300 foot exclusion radius, including his child's day care center. The matter came to hearing before Commissioner Harry Richard Slusher, both parties present and examined by Commissioner Slusher. It is impossible for me to believe that the man completely forgot about the violent incident and the resulting conviction of this woman for assaulting him. Nevertheless, Commissioner Slusher imposed a one year restraining order, increasing the exclusion radius to 500 feet, with no visitation with his child!! The only redeeming quality of this order is that there is a notation that it is subject to change in a pending divorce or paternity action. While most paternity actions are brought with intent to nail the guy for child support, sometimes the father winds up with custody or at least visitation or shared parenting rights. Unfortunately such results are too few and too far between.
To those who do not believe there is gender bias in the system, please explain these results. The criminal prosecutors did the right thing, holding a violent woman accountable for her behavior in the presence of her child and against the child's father. But Court Commissioner Slusher ignored these facts and stomped on the father's constitutional rights! And now this violent woman works for the support enforcers.

Ejigayehu Yitref, DOB April 28, 1955, black female, Mercer Island, Washington 98040 Does not appear to be registered to vote in the State of Washington King County No. 98-2-29878-2 appellant speeding ticket (this file makes for entertaining reading, it is SO unfair that the cops singled her out, she was only going something like 50 in a 35!); King County No. 09-2-38421-5 is the RALJ appeal of a speeding ticket, Renton Municipal No. IN0123390 dated August 8, 2009. Interesting fact: The notice of infraction written by the officer lists her race as "W", even though she is clearly black. Judge found that to be an insignificant scrivener's error! Her basis for appeal: The officer did not pull her over immediately because he called in the license plate to dispatch to determine if the car was reported stolen or if its registered owner was wanted on a warrant or whose license was suspended. Her complaint is that this denied her the opportunity to check her speedometer at the time of the alleged infraction.
By her own admission she was not monitoring her speedometer to insure that she was within the posted speed limits at all times.
News flash: When you significantly exceed the speed limit you will attract the attention of the police! Even if you are white!
