State Writ of Prohibition Against Contempt Prosecution where I was forced to file a Motion to Modify Commissioner's Decision citing Antipeonage Act because the State of Washington imposed a court order that is a direct violation of the Antipeonage Act, requiring me to maintain at least 30 hours of work per week or make 3 job contacts.  Therefore, I display my Brief of Appellant because this is an issue of extreme public importance for which the public should be aware.

Petition for Writ of Certiorari to the United States Supreme Court is considered filed as of the date I mailed it, August 8, 2007, within 90 days of June 6, 2007.  It is docketed as No. 07-184.

One analogy to illustrate the absurdity of the proposition that choice of employer avoids finding of involuntary servitude is with Washington's Death Penalty statute, RCW 10.95.180(1) grants the condemned a choice: lethal injection or hanging.  No one seriously argues that merely because the condemned has a choice in his demise, there is no death penalty.  However, California's Moss v. Superior Court, the Ninth Circuit's Ballek,  and Hawaii's Doe uses this precise logic: if the peon has a choice of employer, there is no involuntary servitude!

Patently absurd, of course!

Allow me to let you in on a dirty little secret here.  Consider this:  Say you are a judge in Washington's court system.  Or any other court system actually, but Washington is the one I am most familiar with.  We all know about the incredible and universal gender bias in family law, and the absolute lack of respect for noncustodial parents as human beings.  Observing this is like observing that the sky is blue.  But it is just not credible that ALL of our judges are THAT BIGOTED.  SOMETHING is placing the thumb on the scales of justice here, that is the only explanation that makes sense!  And here is what it is:  As a judge, you know that if you make a ruling that offends certain elements in our society you will be BORKED!  In Washington, there are two primary means of borking a judge.  1) Putting up credible sounding candidates against your re-election when judges who NEED to be removed for their refusal to enforce Constitutional rights of politically incorrect litigants (meaning noncustodials and others) never face a challenger.  Judge Jeanette Burrage suffered from that fate, and from her own foolishness in admonishing female attorneys for wearing pantsuits instead of dresses.  2) A campaign of judicial conduct complaints.  Justice Richard Sanders has experienced this.  Power Structure just does not like his dissents, but what saves him is that he is popular with the voting public, the only thing that comes even close to frightening the Power Structure.  Notice I use capital letters.  Everyone in Washington smarter and more observant than a doorknob knows we have one, even if we cannot "prove" it.  An organization with access to, say, numerous divorce files without having to spend hours at the courthouse looking them up, would be in a perfect position to organize a CAMPAIGN of Judicial Conduct Commission complaints against a judge who pissed them off.  Litigants in these divorces unhappy with this particular judge will be happy to fill out and file these complaints when prompted.  And because judicial conduct complaints are mostly SECRET, we do not know and cannot verify, if there is ACTUALLY A CAMPAIGN of such complaints against a particular judge.  Because every judge is a human being, and therefore not perfect, there will be at least one incident described in these complaints, where the judge messed up bad enough to warrant discipline!

Same thing with lawyers, which might explain their fear of FORCEFULLY representing noncustodial parents and even to mention the Antipeonage Act in the same context as family law.

So what do we do?  Answer is to realize that the thumb on the scales of justice is political, and is motivated by some unreasoning hatred of noncustodial parents, and/or the Seven Deadly Sins including avarice (fancy word for greed) and there is only one thing we NEED to do in ADDITION to everything else we do: Put OUR thumb on the other side of the scales of justice.

Judicial Conduct Commission complaints, folks.  Bar complaints against support enforcer attorneys.  EVERY time they give you cause to file such complaints!  Clue: What works are lies, excuse me, "misstatements of fact" ;-), told by attorney to court that were uncorrected and repeated after you asserted that the truth is otherwise.  Back it up with evidence.  That gets the disciplinary counsel fired up!

A bit of advice for all you Romeo's out there.  When you find yourself with a lady and it starts to look serious, you might want to scan her name through the Superior Court search engine.  And the Name Search.

  If she has a common name you will want to eliminate the Katherine Smiths who are not her.

 When you do that, then you have some background information to consider.  A criminal record is not necessarily bad, such persons can learn their lesson and reform.

 Even druggies and alkies can get clean and stay clean.  However, a relapse into drug or alcohol addiction can be a wonder to behold!  It is truly one of the most amazing things I have ever seen in my life!

  Somewhat surprisingly, not to me but to too many other men, it is a lady's CIVIL litigation history that raises the red flags.  Is she a defendant in a string of collection and commercial cases, unlawful detainers?  She ever petition for Chapter 7  bankruptcy when she has a job?  Then don't go with her if you think financial responsibility, spending within your means and BEING CAREFUL with your hard earned money are important to you.

 The real important thing for you to watch out for are the domestic violence petitions.

 Okay.

 No such petitions are no guarantee, there is always a first time.

 One petition, she might have met a Mr. Wrong and she might do just fine with a Mr. Right.

 But FOUR petitions?   RED FLAG! RED FLAG! RED FLAG! RED FLAG!

 If it is with the same guy, all that means is that SHE DOESN'T LEARN A DAMN THING!  When men get angry with their women, that is at the top of their list as to why!

 If it is with different guys, hmmm.

 If you are going out with someone with a record like Ms. Bailey, and you wish to have a happy life with a minimum of problems, and ZERO court problems, RUN!!!!

 Oh yeah, you can say, quite self righteously and with an air of moral superiority:

"I have never hit a woman in my life and I will NEVER EVER HIT A WOMAN!!!"

 Right.

 Maybe you have never been TESTED.  Do you really want to be TESTED?

 Some ladies just have the "knack".

 Either they have poor taste in boyfriends (and she is going out with you? hmmmm), or they manage to piss them off, or both!

 Do you really want to have a relationship with a lady with a habit of pissing off her significant others?

 Think of all of the "stupid bitch" things she can do that will drive you up a wall!

You instruct her carefully, assure yourself she understands, to look through the peephole, and if the person is holding a manila envelope or a bunch of papers of the 8.5 by 11 inch variety, DO NOT ANSWER THE DOOR!!!!  The "stupid bitch", after receiving such instructions, will answer the door and accept the papers!

 You are a starting tackle on the best offensive line in football, you win your first playoff game, and you go out to celebrate.  What does she do?  She embarrasses you and humiliates you in public!  You "discuss" this with her in the back alley and the cops haul you off to jail!

 We don't need this shit!

 And if none of the guys she petitioned against ever hit her, or only raised their voices because they can't help themselves, then she is a MALICIOUS PERJURER!  Or a backstabber!  Who needs that?

   Avoid her like the plague.

  • His money is going to be your money anyway when he drops dead.
Divorce advice your wife will be getting
  • Use the children as hostages against your husband.
  • Falsely accuse him of sexual or physical abuse. Just lie in court.
  • Lie and get restraining order barring him from his house.
  • Lie and get restraining order hijacking all his bank accounts.
  • Run up all his credit cards to the limit.
  • Your husband is a scumbag and he deserves all that anyway.

James Nels Burkhead,  DOB June 26, 1960, white male, 6'2" 220 pounds, blue eyes brown hair, Seattle, Washington 98107. Voted by absentee on November 2, 2004  Voted again on November 8, 2005 and February 19, 2008  King County No. 97-3-03191-9 petitioner dissolution with no child.  Seattle Municipal Court No. 450715, DUI, pending. On February 6, 2004 Seattle Police stopped Toyota Pickup for erratic driving and excessive speed.  Breath test yielded a result of 0.08 blood alcohol content. At the March 9 hearing Mr. Burkhead's attorney asked for a continuance because he intends to seek deferred prosecution.  The defense waived speedy trial setting a new expiration date of June 7, 2004.  He is to continue to attend Alcohol Anonymous meetings.  Mr. Burkhead appeared in full suit and tie as did his attorney.  He asked for evening hearing dates because, of course, he would not want to miss work!  He looks a bit like KOMO Channel 4 Seattle television personality Ken Schram without the beard but you could easily tell he is not Schram. The ultimate result of this case is that the Court approved a deferred prosecution.  As a result there are conditions imposed upon Mr. Burkhead:  The standard "be a good boy order": No refusal of blood or breath test, no criminal law violations, and no driving without a valid license and insurance, these conditions last five years, running from March 25, 2004 through March 24, 2009.  In addition, he is not to drive any motor vehicle unless it has an ignition interlock installed that is triggered if it reads more than 0.025 on his breath, this condition also lasts until March 24, 2009.  He is to undergo a chemical dependency assessment and treatment process at Lakeside prior to March 27, 2006.  He attended a DWI Victims Panel, the Court Docket lists this obligation is completed. Other conditions imposed include attendance at 3 sobriety meetings each week and bring proof of such attendance to all Court hearings in this case or be booked for NSP Evaluation.  He is to pay a $400 Probation Supervision Fee and $125 for breath tests for a total financial obligation of $525.  Comment:  This reading is right on the edge.  In Washington the present legal minimum for presumption of impairment while operating a motor vehicle is 0.08.  At trial, the defense could attack the accuracy of the BAC Datamaster, if that is the machine used, or would try to argue that its designed accuracy leaves open the possibility that Mr. Burkhead's blood alcohol content was actually 0.079 or something like that.  A reasonable doubt.  The prosecutor would argue that the testing standard is that when the breath test is administered within two hours of the incident of operating the motor vehicle, and without any additional alcohol added to the person subsequent to operating the motor vehicle, he blows a 0.08 or higher.  Given that the body metabolizes, sweats, and exhales alcohol at a more or less constant rate, a jury can reasonably find that at the time prior to the test, such as when he was operating the motor vehicle, Mr. Burkhead's blood alcohol level was HIGHER.  I believe it is possible that a jury could give Mr. Burkhead the benefit of the reasonable doubt.  But I believe it is likely they will find that a reading of 0.08 proves a higher and therefore legally drunk level when he was in control of his vehicle.  The other argument that the prosecution can make is that even if his level was actually 0.079, it is still illegal to operate a motor vehicle if that is a level sufficient to impair.  The police officers reported that he was speeding and floating back and forth in the lane, forcing other motorists to take evasive action to avoid collisions.  Second Comment: This man copped a deferred prosecution agreement to a charge of driving while impaired.  As the police reported that other motorists had to take evasive action to avoid collision, I would say that presents a greater danger to the public safety than being unable to comply with a child support order. Yet he is able to drive a vehicle provided it has an ignition interlock, and I am prohibited from driving any vehicle at all, even though my driving record over the last five years is COMPLETELY CLEAN!
