State Writ of Prohibition Against Contempt Prosecution where I was forced to file a Motion to Modify Commissioner's Decision citing Antipeonage Act because the State of Washington imposed a court order that is a direct violation of the Antipeonage Act, requiring me to maintain at least 30 hours of work per week or make 3 job contacts.  Therefore, I display my Brief of Appellant because this is an issue of extreme public importance for which the public should be aware.

My latest Reply Brief of Appellant provides the answers to California's Moss v. Superior Court, the Ninth Circuit's Ballek,  and Hawaii's new Child Support Enforcement Agency v. Doe, No. 24457, (Hawaii, December 27, 2005) 109 Hawaii 240, 125 P. 3d. 461, each an obscenity against the Rule of Law.

Petition for Writ of Certiorari to the United States Supreme Court is considered filed as of the date I mailed it, August 8, 2007, within 90 days of June 6, 2007.  It is docketed as No. 07-184.

One analogy to illustrate the absurdity of the proposition that choice of employer avoids finding of involuntary servitude is with Washington's Death Penalty statute, RCW 10.95.180(1) grants the condemned a choice: lethal injection or hanging.  No one seriously argues that merely because the condemned has a choice in his demise, there is no death penalty.  However, California's Moss v. Superior Court, the Ninth Circuit's Ballek,  and Hawaii's Doe uses this precise logic: if the peon has a choice of employer, there is no involuntary servitude!

Patently absurd, of course!

Allow me to let you in on a dirty little secret here.  Consider this:  Say you are a judge in Washington's court system.  Or any other court system actually, but Washington is the one I am most familiar with.  We all know about the incredible and universal gender bias in family law, and the absolute lack of respect for noncustodial parents as human beings.  Observing this is like observing that the sky is blue.  But it is just not credible that ALL of our judges are THAT BIGOTED.  SOMETHING is placing the thumb on the scales of justice here, that is the only explanation that makes sense!  And here is what it is:  As a judge, you know that if you make a ruling that offends certain elements in our society you will be BORKED!  In Washington, there are two primary means of borking a judge.  1) Putting up credible sounding candidates against your re-election when judges who NEED to be removed for their refusal to enforce Constitutional rights of politically incorrect litigants (meaning noncustodials and others) never face a challenger.  Judge Jeanette Burrage suffered from that fate, and from her own foolishness in admonishing female attorneys for wearing pantsuits instead of dresses.  2) A campaign of judicial conduct complaints.  Justice Richard Sanders has experienced this.  Power Structure just does not like his dissents, but what saves him is that he is popular with the voting public, the only thing that comes even close to frightening the Power Structure.  Notice I use capital letters.  Everyone in Washington smarter and more observant than a doorknob knows we have one, even if we cannot "prove" it.  An organization with access to, say, numerous divorce files without having to spend hours at the courthouse looking them up, would be in a perfect position to organize a CAMPAIGN of Judicial Conduct Commission complaints against a judge who pissed them off.  Litigants in these divorces unhappy with this particular judge will be happy to fill out and file these complaints when prompted.  And because judicial conduct complaints are mostly SECRET, we do not know and cannot verify, if there is ACTUALLY A CAMPAIGN of such complaints against a particular judge.  Because every judge is a human being, and therefore not perfect, there will be at least one incident described in these complaints, where the judge messed up bad enough to warrant discipline!

Same thing with lawyers, which might explain their fear of FORCEFULLY representing noncustodial parents and even to mention the Antipeonage Act in the same context as family law.

So what do we do?  Answer is to realize that the thumb on the scales of justice is political, and is motivated by some unreasoning hatred of noncustodial parents, and/or the Seven Deadly Sins including avarice (fancy word for greed) and there is only one thing we NEED to do in ADDITION to everything else we do: Put OUR thumb on the other side of the scales of justice.

Justice Conduct Commission complaints, folks.  Bar complaints against support enforcer attorneys.  EVERY time they give you cause to file such complaints!  Clue: What works are lies, excuse me, "misstatements of fact" ;-), told by attorney to court that were uncorrected and repeated after you asserted that the truth is otherwise.  Back it up with evidence.  That gets the disciplinary counsel fired up!

John William Brandon,   Olympia, Washington 98501 DOB January 16, 1955 Voted on November 2, 2004, November 8, 2005, September 19, 2006, November 7, 2006 and November 6, 2007  Thurston County No. 03-2-02502-7 plaintiff civil;   Filed Chapter 7 bankruptcy, In re Brandon, United States Bankruptcy Court, W.D. Wash. No. 03-43987.  Here is the scoop from this man who, before he was disabled, (Hey! Just because a Nazi war criminal is in a wheelchair doesn't mean the Jews owe him any sympathy, same thing here!) earned his living enforcing others' financial obligations, who, under 11 U.S.C. §523(a)(5), cannot obtain this kind of relief: He lists on Schedule F as unsecured debts including: Bank of America: $14,745.00  Chase: $4,751.00  First USA: $49,123.00  First Bank: $11,930.00  MBNA America: $9,160.00  USAA Federal Savings & Loan: $1,859.00   TOTAL UNSECURED DEBT: $91,568.00!!!  The Trustee filed a "Chapter 7 Trustee's Report of NO Distribution".  If I remember 11 U.S.C. §727 correctly, that means the unsecured creditors got STIFFED!!!  The unsecured creditors received ZERO payment!!!!  And can never again attempt to collect any part of these debts.  If any of this credit card money was used to purchase goods for the benefit of their children, then we can truthfully say that the Brandons got out of paying some of their own child support!!! Incidentally they, out of the goodness of their hearts, agreed to pay Pentagon Federal Credit Union $2,068.14 with 8.99% interest in what is called a "reaffirmation agreement".  When such an agreement is filed by a debtor in a bankruptcy case, the debt is not discharged and survives the bankruptcy.  The debtor essentially entered into a new contract and agreed to pay the debt.  We can all presume that they were not motivated by any threat of physical violence or other threats of illegal coercion, say, imprisonment for debt through contempt proceedings and arrest, because that would be extortion and we would not want anything like that going on!

There is a new probate case, Pierce County No. 07-4-01581-0 listing a John William Brandon as "deceased", meaning, of course, that he has gone to his hearing before the Angels at the Pearly Gates.  Is this the support enforcer?  The Thurston County John W. Brandon is still listed as registered to vote and he voted on November 6, 2007

We all know how being dead does not always stop people from voting!

If you earn more than the median family income, there are a bunch of new mathematical tests to keep the "presumption" of abuse from arising or to rebut said presumption.  While you cannot get rid of a child support debt under the new Bankruptcy Code anymore than you can under the old Code, you can include child support and alimony obligations in your monthly expenses for the purpose of avoiding the presumption of abuse.  Thus if you are clobbered by an unreasonable child support order, you should still be able to use the Bankruptcy Code to get rid of, meaning not pay, your non-child support non-alimony unsecured debts.

Still, you have to admit, as the Republican Base is pissed at their Party for spending too much money and for going along with big new spending initiatives and for failing to get rid of such ridiculous federal laws as the 1.6 gallon per flush toilet rule, and as the moonbat left wing is fit to be tied over Nancy Pelosi not delivering on forcing our surrender in Iraq, and as the immigration policy continues to be "will the last person leaving Mexico please turn out the lights" and as our jobs keep being shipped overseas for cheap labor, where Congress has an even lower approval rating than President Bush, and of course we noncustodial parents have absolutely no reason to support the re-election of anybody,

There are several ways to look at the claims for shoplifting civil liability by Target and Nordstrom for parental liability for her children shoplifting.  1) She got out of paying some of her own child support. 2) It sure is tough raising kids without a father around to instill such values as discipline, right and wrong, Thou Shalt Not Steal, etc. 3) But then again, Target and Nordstrom are playing their own little fraud game!  We had a client who had this problem.  Teenager stole stuff from a store.  The store sent a bill for parental liability, based on RCW 4.24.230.  Client asked our office to look into it.  At the law library, I looked up RCW 4.24.230 in the annotated statute books.  The most relevant case cited therein is Harold Meyer Drug v. Hurd, (1979) 23 Wash. App. 683, 687, 598 P. 2d. 404.  In this case a juvenile shoplifted an item worth less than $2 and when caught by store personnel, immediately returned the stolen item.  Harold Meyer brought suit against the parents for civil liability and attorney’s fees under RCW 4.24.230.  The superior court found for the defendant parents and awarded attorney’s fees of only $10.00.  On appeal, the Court of Appeals for the State of Washington found that it was not the intent of the Washington Legislature to provide merchants with an additional means to extract funds from parents of juveniles when the stolen merchandise is returned to the store.  The purpose of the statute was to provide the stores with additional recovery if they have to sue to obtain return of stolen merchandise or payment for such merchandise.  It was therefore frivolous for Harold Meyer to sue the parents when their merchandise was already returned and the juvenile brought to answer for his crime in the juvenile courts.  The Court of Appeals increased the award for attorney’s fees and costs under Civil Rule 11 for bringing a frivolous lawsuit.  RCW 4.24.230 has not been significantly modified by the Washington Legislature since.  Under such circumstances, the courts usually use a rule that the Legislature, who can modify or repeal a statute during any session, is presumed to know about court decisions interpreting their laws, and by not passing any bills to modify the statute, it has acquiesced with the courts’ interpretation.

So parents, your kid is caught shoplifting.  The merchandise was returned immediately or you were able to gather it up and return it to the store.  Being the parent, you did not commit the crime, you are free to return the stolen merchandise.  You won't be prosecuted for possession of stolen property because, of course, the talk radio, Internet blogs, this website, and even the MSM will have a field day shaming the prosecutor's office into dropping it!  As long as the stolen stuff is returned, you have no civil liability.  If the store sends you one of these bullshit letters, you are free to ignore it or to tell them to go piss on an electric fence!  May Chris Heer just listed these claims and discharged them through her Chapter 7 bankruptcy!

Did Mr. Highsmith avoid a felony conviction each and EVERY time he copped a plea?  If not, did he obtain a court order reinstating his right to vote?  Under what cause number?  At least he has since found gainful employment with the State committing crimes of peonage!
