Formerly the Sunshine State. Now the Windblown State. The Hanging On For Dear Life Chad State. The State where half of the debris is actually from Alabama! Some of Mobile has been relocated to Pensacola and some of Pensacola has been relocated to Mobile! There are even Cuban immigrants who did not actually intend to immigrate! Elian Gonzales is wandering around in a daze wondering, "How did I wind up back here?" and saying things like "Now I know how Dorothy felt."
This is the state that gave us Janet Reno. Janet Reno was the Dade County Prosecutor who was famous for her aggressiveness in enforcing Florida's child support peonage system. So much so that she is celebrated in song for this role: Janet Reno by 2 Live Crew, or look then up on their Unofficial Site. The only father Reno had any sympathy for was Elian Gonzales' dad.
The Department of Revenue operates the Child Support Services, its Enforcement Information page admits peonage.
In Title VI, Civil Practice and Procedure, Chapter 61 Part 1 provides for divorce and child support and Chapter 88 is the Uniform Interstate Family Support Act
Some interesting provisions:
Section 741.212 prohibits recognition within Florida by any agency of the state or local governments of any same gender marriage, wherever such marriage is performed and without regard to the recognition by any other jurisdiction within and beyond the United States of such marriage.
This is to defend the institution of marriage. We would not think that marriage is threatened by Chapter 61 Part 1 which greatly rewards female petitioners for breaking up the marriage with nothing even remotely resembling unbiased tribunals!
Section 798.01 Living in Open Adultery defined as a crime.
Section 798.02 Defines unmarried man and woman lewdly and lasciviously associating and cohabiting together as a crime. I would like to know how they can prove to a jury the element of "lewdly and lasciviously" without violating every Americans' right to be secure in their persons, houses, papers and effects from unwarranted searches and seizures!
Section 800.02 defines "unnatural and lascivious acts" as a crime even if both are mutually consenting adults in the privacy of their home. Oh, Puhleeze! Even when there are no hurricanes around, Florida is not for lovers if they love the wrong way!
Article I Section 2 of the Florida Constitution declares the inalienable rights of all persons, including the right to be rewarded for industry and to acquire, possess, and protect property. Forfeited upon divorce and loss of custody of child.
Article I Section 8 of the Florida Constitution declares the right of the people to keep and bear arms in defense of themselves and the lawful authority of the state with a mandatory three day waiting period for purchase of handguns not applicable to holders of concealed weapons permits.
Article I Section 9 of the Florida Constitution is the state Due Process Clause. Does not apply to family law and domestic relations.
Article I Section 11 of the Florida Constitution prohibits imprisonment for debt except in cases of fraud. I guess child support is a fraud.
Article I Section 12 of the Florida Constitution declares the right of the people to be secure in their persons, houses, papers and effects against unreasonable searches and seizures, against unreasonable interception of private communications, and no warrant shall issue except by probable cause supported by affidavit, describing the places to be search, the things to be seized, and the nature of the evidence to be obtained. In the case of Rush Limbaugh, ALL medical records may be seized on warrant with probable cause that ALL medical records would relate to an accusation of "doctor shopping" to obtain a larger quantity of prescription medication than any one doctor would prescribe.
I think I will not be going to Florida for medical services. I value my medical privacy. And my right to vote with the expectation that my vote will be counted accurately and added to the appropriate totals. Which is why I live in King County, Washington!
Article I Section 17 of the Florida Constitution prohibits excessive fines and bails, cruel and unusual punishments, indefinite imprisonment, and unreasonable detention of witnesses. Does not apply to family law and domestic relations.
Article I Section 23 of the Florida Constitution provides that "every natural person has the right to be left alone and free from government intrusion into the person's private life except as otherwise provided herein." "herein" means within the Florida Constitution. Does not apply to Rush Limbaugh or to divorced parents.
