The Family Court of Delaware imposes and enforces child support
The Division of Child Support Enforcement of the Health and Social Services enforces child support, including referral for contempt proceedings.
I wonder if Delaware will bring back the whipping post to punish noncustodial parents who are unable to keep up with their support orders?
Title 10 Courts and Judicial Procedure
Title 11 Crimes and Criminal Procedure
Part 1 Chapter 5 Subchapter V Subpart A offenses relating to children Includes 11-§1113(b) which defines failure to comply with a support order to be criminal nonsupport. 11-§1113(d) reads:
(d) In any prosecution for criminal non-support or aggravated criminal non-support, it is an affirmative defense that the accused was unable to pay or provide support, but the accused's inability to pay or provide support must be the result of circumstances over which he or she had no control. Unemployment or underemployment with justifiable excuse shall constitute a defense to any prosecution for criminal non-support or aggravated criminal non-support. Justifiable excuse may be established where the accused has been involuntarily terminated from his or her employment or otherwise had his or her income involuntarily reduced and is diligently and in good faith seeking reasonably appropriate employment opportunities under all the circumstances or pursuing self-employment.
And where there is the absence of the defense of diligently and in good faith seeking employment or pursuing self employment, then the statute defines a crime in violation of the 13th Amendment and is declared null and void by 42 U.S.C. §1994. Any prosecution for violation of this statute is the crime defined by 18 U.S.C. §1581. The presence of this statute on the Delaware books renders all support orders in this state null and void as peonage.
We don't need no stinking 13th Amendment! Due process, equal protection? Nice suggestions, but lets get real!
