Therefore, I display my Brief of Appellant because this is an issue of extreme public importance for which the public should be aware.

Speaking of shared parenting, Washington Shared Parenting has their website up and running. It contains suggestions on how to "stop treating us like shit" for those who "get it". ;-) He links to the California Shared Parenting Alliance and notes a statement by former NOW President Karen DeCrow urging the adoption of the presumption of joint custody in divorce law. They bring us a story about the sound recordings of hearings before the Commissioners being deleted. They have been busy! They have an on-line database of Division of Child Support employees.

An interesting commentary on Islamic Family Law Funny how unfair it is recognized when the mother may not have custody of child, may not make decisions considering the child, and where the father can restrict a mother's access to the child. But it is okay in Western societies to do this to fathers!
I will say it again: if the Jihad wins, it will be because western fathers decided that sharia family law practice is a better deal for them then being clobbered by female favoring unilateral (what no-fault really is) divorce and the Child Support Crusade.
We do not have to adopt sharia, we only have to restore American constitutional rights to American family law practice and adopt a gender neutral family law practice that places the burden of PROOF on the PETITIONER in any divorce and allows mutually agreed divorces where the terms comport with constitutional provisions, including the 13th Amendment's prohibition of slavery and involuntary servitude.

Now I certainly don't agree with everything this web site says. I am not misogynist like that. However, they did a Hell of job digging out an alternative set of statistics that contradict much of the thinking that goes into femi-nazism and the weird anti-father attitudes of our judges. It also confirms what I am saying: That the present family law system is not about supporting the children in the event of divorce, but about encouraging the less responsible partner to file for divorce, get custody of the kids by all means necessary, including perjury and false allegations of abuse, and financially destroying the father so they can maximize the size of government at the expense of everything else in society. That might explain how we elect Republicans to Congress and the White House, and DAMN! The federal government continues to grow!

Separated Parenting Access and Resource Center. Interesting site. I believe that if we as a policy awarded custody to the parent who has the job, we could eliminate much of our welfare and child support enforcement spending and cut taxes at all levels of government. Or we could use the money for a new space program and add the Moon and Mars as new states of the Union. I see nothing wrong with a woman having custody of her children provided she can support them and she does not use them as a weapon against their father. The government needs to stop using them as an excuse to violate its own Constitution and we need to demand that it cease and desist such violations.

The Center for Liberty and Privacy and the Alliance for Freedom and Alimony, Inc. retain attorneys who are fighting for our rights under substantive due process under the 14th Amendment. They are also looking at involuntary servitude and peonage challenges under the 13th Amendment and the Antipeonage Act.

Sorry but I'll Have to Pass
It's almost the one year anniversary of the death of Perry Manley, a Seattle fathers' activist who committed "suicide by cop" last June. Manley entered the federal courthouse in Seattle with what appeared to be a grenade, refused to surrender or negotiate, and made a sudden move, after which police fired, killing him. Unfortunately in the wake of his death Manley has been made into a hero by certain misguided fathers' activists. For example, one activist recently wrote:
"I have never forgotten Perry Manley...I grieved for him then. I grieve for him now. I remember when they shot him down. I watched it all unfold on TV...Perry wasn't asking for much. He just wanted justice and to be a Dad. Instead people treated him like a 'kook.' But we know he was a martyr for our cause--no matter what anyone says to the contrary. I will never forget him. Sorry, but I'll have to pass. I gave my opinion in this enewsletter at the time of the shooting last year, and was greatly criticized by some for it. What I wrote still seems accurate to me. It appears below, exactly as it was a year ago:
My Opinion of Perry Manley's 'Suicide by Cop'
Many of you have written to me asking my opinion of Perry Manley's 'Suicide by Cop' Monday in Seattle. Manley, angry over a family court matter, entered the courthouse with what appeared to be a grenade. According to police, Manley refused to surrender or negotiate, and made a sudden move, after which police fired, killing him. The grenade turned out to be a fake--Manley was unarmed.
As for Manley's family court grievance, the facts, as far as I can ascertain them, are:
Manley divorced in 1990 from his wife, with whom he had 3 kids.
Manley claimed the child support system had treated him unfairly. I don't know if this is true, but it certainly is a common problem for divorced dads.
Manley claimed that his ex-wife interfered with his visitation with his kids and alienated them against him. Again, I don't know if this is true, but it certainly is a common problem.
Manley claimed that paying child support in and of itself was unconstitutional and a violation of his human rights. He made this his central issue, as opposed to the alleged violations of his custody and visitation rights.
Manley claimed that a judge who had ruled against him had violated the constitution in his dealings with him, thus violating his oath of office and committing "treason" which, Manley said, is punishable by death.
I have received many letters telling me that Manley is a hero, and even that I should honor him (or his memory) on my radio show this Sunday. I'll pass. Manley was unarmed, and that certainly counts in his favor, but his actions were reckless and needlessly put innocent civilians in harm's way. It served no constructive purpose but instead makes it easier for our many enemies to portray divorced dads as violent nuts.
While many divorced dads are abused by the child support system, it is unclear whether the child support demands upon Manley, who had three children in need of support, were unreasonable. Manley made child support, not his rights as a father, his central issue.
Had Manley done what David Chick did, I could support him. David Chick is a hero. Gary LaMusga is a hero. Jolly Stansby and Ron Davis and Gary S. and Edgar P. and John Brumbaugh and Benoit Leroux are heroes. Manley may (or may not) have been a victim of a family law system which has torn millions of fathers and children apart. But either way there was nothing heroic about his actions this week."
Around the same time last year, in a letter to one of my detractors, I wrote:
"If Manley had talked about his access to his children and made them the issue, I would be a lot more sympathetic. But he rarely mentioned that, instead focusing on this child support constitutionality nonsense. He was asked to pay $650 a month to support three children (apparently it was only $210 a month in the beginning). Was that unfair? Is that what he died for? OK, he didn't like paying through the government, which I understand, but where's the real grievance here? He had 3 kids in need of support, he was the family breadwinner so he was obligated to pay it--so what? (inserted comment: Glenn done drank the "you owe it to them, anyway" Kool-Aid!!) I've got 10,000 letters in my email box from guys who have bigger grievances than this. If he made the issue his access to his kids I'd sympathize, but he hardly even mentioned his kids. Also, given his mental instability (which many who knew him have written to me about), it's possible that he was alienated from his kids in part because of his own actions, not his ex-wife's."
Mr. Manley DID talk about access to his children. But what he understood, what too many, including Glenn Sacks refuse to see, is that Child Support is THE reason we do not get shared parenting or custody to the breadwinner!!! It is THE motivation behind the gender bias Glenn Sacks complains so bitterly of. Take Child Support and the denial of equal protection of state constitutions that prohibit imprisonment for debt out of the equation, then we will HAVE shared parenting. Under the present circumstances, paying Child Support is paying the kidnapper's ransom, without getting the hostage back! Asking for fair treatment while expecting the payment of child support by those unfairly treated and not objecting to the violation of most constitutional provisions protecting our rights in the enforcement of these obligations is like asking for solutions to the energy crises without building nuclear power plants, solar and wind power systems, biodiesel fuel production, exploiting the oil shale of Wyoming and Colorado, reasonable conservation measures, and drilling for petroleum in Alaska. To SOLVE the problems we, including Glenn Sacks, complain of, we need to DESTROY the Child Support Apparatus. That REQUIRES SCREAMING FOR THE ENFORCEMENT OF THE PEONAGE LAW!!!
Glenn, we love you, but please reconsider.
BTW, Manley's children were adequately supported by the ex-wife and her new husband, the guy with whom she committed adultery and thereby SABOTAGED her marriage to Perry Manley. Before no-fault divorce, proof of the adultery would have saved for Perry custody of the children because a parent who leads by the example of adultery was considered an unfit parent deserving to lose custody of the children even if not also bound over into child support peonage. A constitutional limitation on the parent's liability to pay support to a custodial parent with sufficient resources is the Troxel minimum. It is based on Meyer, Pierce, Yoder and other decisions establishing fundamental rights of the parents.
Asserting constitutional rights and principles is NEVER misguided! To deny them is treason!

The California Alliance for Families and Children advocates reforms such as joint custody and the reform of child support and domestic violence legislation. They still don't get the Antipeonage Act though, they still would allow the imputing of income where there is a finding of "willful underemployment for the primary purpose of thwarting adequate support". "Willful underemployment" is a Constitutional right under the 13th Amendment! Oh well, nobody's perfect.

(But hey, Dr. Pelling won damages against a court official who assaulted him!) This reminds us that one of the motivations of the American Revolution was the threat to bring Americans over to Britain for trial rather than allow Americans to be tried in the colonial courts. A British frigate sent to Rhode Island for such purpose was sunk in Narragansett Bay. Upon investigation, no one would own up to knowing who was involved in the sabotage! A core value of American law, the openness of courts and the freedom to discuss the consequences of public policy where it matters the most, in the courts, is not yet as ingrained in British practice. British family law courts are, under Acts of Parliament currently in effect, the modern Star Chamber where litigants are bound to secrecy. This is also the case in Australia and New Zealand.

Shucks, we're still angry at our school boards for metri-fornicating our high school track meets! The Metric System Sucks! Not entirely accurate (Snapple is sold in PINT jars, therefore, it is NOT metric), quite opinionated, and definitely humorous! While I don't think the Hanging Gardens of Babylon have anything to do with English measures, what with cubits and all, it gets over 110 Fahrenheit in Iraq! That is why the folks are so crazy over there, even our troops at Abu Ghraib! When the temps went over 110, we've no doubt had the Hanging Dried Sticks and Brown Leaves of Babylon! And by the way, why are we calling .30 calibre guns and ammo 7.62 mm? That makes as much sense as Interstate Highways in Hawaii!!

Justice Guerette excused the lies that were presented as evidence, i.e. perjury, but then made excuses for lawyers and such, and stated that "So long as there is not a big lie, then I'm all right." Justice Guerette acknowledged that the evidence presented included lies, and then based his decision against Mr. Osborne in part on these lies. For protesting this, Mr. Osborne is now being prosecuted for criminal libel.

We can be forgiven for believing that this is a Nazi-style government sponsored hate campaign against noncustodial parents.
An interesting Florida State University Law Review treatise by Cynthia A. McNeely, Lagging Behind the Times: Parenthood, Custody, and Gender Bias in the Family Court, explaining some of the origins of the problem. By listing what happens when fathers challenge the gender bias rampant in the family courts under the 14th Amendment, it illustrates why I chose the more objective and simpler arguments based on the 13th Amendment and the Antipeonage Act. That these laws prohibit coercion of labor in liquidation of any debt or obligation is as simple, straightforward and obvious as the concept that an inch is now defined as 25.4 millimeters. As 18 U.S.C. §1581 has never been found void for vagueness, then it follows that it is not vague and that child support and alimony are obviously embraced by the words of 42 U.S.C. §1994, "debt or obligation, or otherwise". The chicanery by the courts that I have recorded on this website in response to my claim of peonage is due to the realization on the part of the judges and their staffs that there is no way they can write a credible published opinion that can stand the scrutiny it would get as a citable precedent without ruling that I am RIGHT!
Of course, I do not agree with every opinion published on these websites. As an example, I believe that letting homosexuals get married will not destroy marriage or society. The hate campaign against heterosexual fathers we can call the Child Support Crusade has already done that. Add the brand new Supreme Court decision in Elk Grove Unified School District v Newdow. If the father is noncustodial, no matter how much time he actually spends with the child he lacks standing to represent his children's interest! THAT IS A DECLARATION OF WAR ON NONCUSTODIAL PARENTS!!!! All homosexuals getting married will do is allow homosexuals to experience what we heterosexuals experience when our spouses file for divorce. Then we might get some new allies!

The Equal Justice Foundation is another great source of information on all manners of Constitutional rights violations, including the rampant anti-male bias in family law and domestic violence. Those who are quick to judge a man who is accused of assaulting his wife are often completely unaware or uncaring that sometimes, the woman is a total nutcase and therefore quite impossible to live with. With the bias in custody determinations and the insane Child Support Crusade, many a man feels compelled to stay with a nutcase wife than leave her.
